1. Agreement to Terms
By accessing or using any services provided by AS Soluciones Digitales ("Company," "we," "us"), you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a company or organization, you represent that you have authority to bind that entity.
2. Services Description
AS Soluciones Digitales provides enterprise infrastructure services including but not limited to:
- Colocation hosting in Tier IV certified data centers
- Managed cloud architecture, deployment, and operations
- Cybersecurity services including SIEM, DDoS mitigation, and compliance
- Network services with high-performance connectivity
- Backup, disaster recovery, and business continuity solutions
- 24/7 managed IT monitoring and support
3. Account Registration
To use our services, you must:
- Provide accurate, complete, and current registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized use of your account
- Be at least 18 years old or have legal authority to enter into contracts
You are responsible for all activities that occur under your account, including actions by authorized users you designate.
4. Payment Terms
- All services are billed in advance on a monthly or annual basis as specified in your service agreement
- Payments are due within 30 days of invoice date unless otherwise agreed
- Late payments may incur interest at 1.5% per month on outstanding balances
- We reserve the right to suspend services for accounts overdue by more than 15 days
- All fees are non-refundable unless specified in your SLA or service agreement
5. Service Level Commitments
Service availability, performance guarantees, and remedies for downtime are governed by the applicable Service Level Agreement (SLA). The SLA forms an integral part of these Terms.
6. Acceptable Use
Your use of our services is subject to our Acceptable Use Policy, which prohibits illegal activities, network abuse, and other harmful conduct. Violations may result in immediate service suspension or termination.
7. Intellectual Property
- You retain all rights to your data and content hosted on our infrastructure
- We retain all rights to our proprietary technology, tools, and service methodologies
- Our trademarks, logos, and branding may not be used without written permission
8. Data Protection
We handle your data in accordance with our Privacy Policy and applicable data protection regulations. We implement industry-standard security measures to protect your infrastructure and data.
9. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim
- We are not liable for indirect, incidental, consequential, or punitive damages
- We are not liable for losses resulting from force majeure events, including natural disasters, acts of war, or government actions
10. Termination
- Either party may terminate services with 30 days written notice
- We may terminate immediately for material breach or violation of our Acceptable Use Policy
- Upon termination, you must retrieve your data within 30 days
- Outstanding fees remain due and payable upon termination
11. Dispute Resolution
Any disputes arising from these Terms shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with applicable commercial arbitration rules.
12. Changes to Terms
We may modify these Terms with 30 days prior written notice. Continued use of our services after the effective date constitutes acceptance of the updated Terms.
